Why Mediate ?

Over 40 years of experience as a litigator has taught me that litigation is rarely the best way to resolve a dispute. It’s expensive, time-consuming, and unpredictable. A mediated negotiation leading to a settlement is almost always preferable.

Keys to a Successful Mediation

The main key to success at mediation is the ability to recognize the influencer underlying the disputes. While many cases do involve sincerely-held differences of  views, a surprising number of disputes bring into play emotional, gender-based, or even culturally-based influences. If these influences are not identified and addressed, a dispute is far less likely to settle at mediation.

Once this has been addressed, parties must be made to understand economic realities. In many, if not most cases, reasonable settlements simply make more economic sense than rolling the dice at trial.

Finally, parties must appreciate the inherent fairness of the compromise they are being asked to make. A well-trained mediator should have the credibility needed to help create this level of understanding so that a settling party feels content with the result.

I have been a litigator since 1980. I have acted on both sides of all kinds of business disputes in industries as diverse as land development, automotive, and wine-making. I have acted for clients from the wealthy and successful to those barely able to afford access to justice. My cases have included emotionally-charged business disputes between family members, battles between egotistical industry leaders, and David and Goliath showdowns in which I have sometimes acted for David and sometimes for Goliath. I haven’t seen it all, but I’ve seen an awful lot. I have experience, and with that, I have credibility. I am a creative problem-solver and I can be very persuasive.

In addition, I’ve received the best training out there – a Master of Laws degree in Alternative Dispute Resolution (ADR) from Osgoode Hall Law School. I’ve learned from the best.
